Guarantor Notice

1. Why you are receiving this notice

A loan applicant has given us your details because they would like you to guarantee their loan. This notice is given to you under the Personal Data Protection Act 2010 (PDPA). Applicants must have your permission before giving us your details and should share this notice with you.

You are not obliged to act as a guarantor. You only become one if you sign a guarantee with us.

3. Personal data we collect about you

• From the applicant: your name, NRIC or passport number, and your relationship to the applicant, and may include your phone number, email address and address.
• From you: contact and address details, employment and income information, identity documents, and signatures when you review and sign the guarantee.
• Identity verification: if you sign electronically, a photo of your identity document and a selfie or liveness check. Facial images used for verification are biometric data, which the PDPA treats as sensitive personal data; we process it only with your explicit consent.
• From third parties: credit reports from registered credit reporting agencies and screening results, with your consent or as permitted by law.

4. Why we use it

• to assess the loan application, including whether you are able to act as guarantor;
• to verify your identity and meet anti-money laundering and other legal obligations;
• to prepare, sign and keep records of the guarantee;
• to contact you about the loan you guarantee, including if the borrower falls behind on payments;
• to recover amounts owed under the guarantee, if it becomes necessary;
• to handle your questions, requests and complaints.

We need this information to consider you as a guarantor. If you do not provide it, we may not be able to accept you as guarantor, which may affect the applicant's application.

5. What being a guarantor means

• If the borrower does not pay, we can ask you to pay the amounts owed under the loan, up to what your guarantee covers, without first taking action against the borrower.
• Your guarantee usually continues until the loan is fully repaid, even if the borrower later stops talking to you.
• If you do not pay when asked, we may take legal action against you, and it may be reported to credit reporting agencies, which can affect your ability to borrow.
• Before signing, read the guarantee and the borrower's loan terms carefully. We will give you a copy. You may wish to get independent legal advice.

6. Who we share it with

We share your personal data only as needed: with the borrower (limited to details about the guarantee), identity verification, e-signature and screening providers, credit reporting agencies, our payment, IT and hosting providers, our advisers and debt recovery agents, and authorities such as KPKT when the law requires it. We do not sell your personal data.

7. How long we keep it

If you become a guarantor, we keep your data while the guaranteed loan is outstanding and for 7 years after it is fully settled, or longer while a dispute or legal claim is unresolved. If you do not become a guarantor, we keep it only as long as needed for the application and our legal obligations, then securely delete it.

8. Your rights

You can ask to access or correct your personal data, withdraw consent where we rely on it, or limit how we use it for direct marketing.
